Your account name is what you use to log into the service. We set it to be your email address or mobile phone number, depending on whether you arrived to us by mobile or web. It is not the name you flirt with. Once your account name is set up, it's fixed, but you can change the name you flirt under (and all other details in your profile, including your email address and / or mobile number) any time you like.

If you have chosen to use Flirtomatic Mobile, you must provide correct information about yourself so that we can keep in contact with you and let you know that you have new messages.

If you register from a banner ad that you have seen on another mobile site, we will be passed your mobile number from your network operator. This is so that we can get your account set up as quickly as possible and so that you can get flirting immediately. We use your mobile number as your account name and we send your signup details to your phone as an SMS for confirmation. We don't sell your number to anyone else.

Your login details for the web and mobile are the same - so you can move seamlessly from your PC to your mobile, flirting all the way!

Flirtomatic is ABSOLUTELY FREE to use on both web and mobile (data charges may apply for mobile users). This includes all the chat you can manage, searching for matches, looking at photos, rating people and lots more.

If you would like to buy any extras on Flirtomatic, you do this with Flirt Points. Flirt Points are the Flirtomatic currency and you use them to buy virtual gifts, to see 'Who's rated me' and to 'Delete my freak'.

You can make a payment by charging it to your mobile phone bill or by credit or debit card.

When you decide to buy Flirt Points by paying on your mobile phone bill, we will attempt to receive payment. If your order is accepted, we will send you a reverse charge text, which will automatically charge you for the points. You won't be able to cancel once we start to action your request.

If you decide to pay by credit or debit card, the name will come up as Handmade Mobile Entertainment Ltd.

If the payment that has been made by mobile bill, credit or debit card is rejected for some reason and you have already spent Flirt Points, you will find yourself in a negative points balance. You will need to make a payment that is accepted by our payment providers in order to spend points once again.

Prices mentioned in these terms and conditions and on our site include VAT unless we tell you otherwise. Our VAT number is 843685496. Make sure you check our site now and then for price changes.

You give us the right to display your profile on the web or WAP site and (unless you tell us otherwise when you register) you give us the right to put your photo and your video on the web or WAP site and, if you're lucky, in the 'new user' section on our home page and to promote our service. If you're even luckier, we may want to use your photo or video for other things, but if so we'll always contact you first to make sure you agree.

You can remove photos and videos from your own profile whenever you like, but you won't be able to remove stuff that you add to another user's profile.

All words, pictures and logos already on our site belong to Flirtomatic and their partners. Please don't steal them.

All Flirtograms sent from the Administrator (that's us) are recognisable by the Flirtomatic logo on the left hand side. These Flirtograms can be replied to and all queries will be dealt within 48 hours.

All photos and videos submitted to Flirtomatic will be checked to make sure you haven't sent us any porno stuff, and loaded onto your profile within 24 hours. Photos and videos with naughty stuff and bad quality photos and videos will be rejected - we'll let you know.

From time to time we will send you SMSs and emails to communicate stuff to you. There is no charge to you for this and if you don't want this stuff just follow the 'unsubscribe' instructions.

We will do our best to ensure that you can always use the service perfectly (both on web and mobile). However, due to the nature of the Internet and mobile connectivity, this cannot be guaranteed. Also, your access to the service may be occasionally suspended or restricted to allow us to fix stuff or add new things to the service. We will attempt to do this not very often, and in the middle of the night when we hope you are getting some sleep.

Just to be clear, this contract is between you and Flirtomatic and no one else. By signing up to Flirtomatic, you agree not to run around and tell people how they can use the service in your name. This means you need to keep your account name and password secret. Whatever happens when your account name and password are being used is down to you. If someone else uses your phone or web account, you are responsible, not us.

Flirtomatic is for those over 18 only. If you are not over 18, you may not use the service. Not even if you are 16 going on 17. Be patient.

You promise to behave. Flirting should be a laugh. Please don't mess it up with bad stuff. You know what we mean, but let's spell it out as there is a fine line between good naughtiness and bad naughtiness.

If we have any causes to believe you are doing something illegal or seeking to facilitate something illegal through Flirtomatic we will not hesitate to report you to the police. Remember, we record all conversations for your safety.

By registering with Flirtomatic, you agree:

You will not send, publish, promote or otherwise transmit any illegal, abusive, threatening, harmful, harassing, defamatory, vulgar, obscene, hateful, racial, ethnically insulting or otherwise objectionable material of any kind or nature;

You will not send, transmit or post any material that is not yours or that is defamatory or that encourages conduct that could constitute a criminal offence, give rise to liability or otherwise violate any applicable laws or regulations. In other words, don't use Flirtomatic to break the law;

You will not use this service for any other purpose than its intended purpose (which is fun flirting) for example selling second hand cars, advertising dodgy massage services, directing people to your weird web site or similar; and,

You will not disrupt the Flirtomatic network. You must not use any device, software or routine that attempts to interfere with the proper functioning of the service. You must not pretend to be someone you are not.

If we suspect you are doing any of the above, we reserve the right to look through the content of your messages and to immediately cut you off.

Because we don't want to be heavy handed, we don't watch everyone all the time, like some services. So we cannot control everything that appears, or everything that is said. We can take people off the system for breaking our rules (you'll need to tell us if you come across this), but Flirtomatic has no direct control over the quality of the content, compatibility or safety of the members, nor can we guarantee the truthfulness, accuracy or completeness of any posting on this service. In plain speak, not everyone is truthful or good. Use your common sense and judgement, just as you do when you meet people at work, on a train, in the pub. Recognise the possibility that other members' information may be inaccurate or deceptive.

We will look into a member's conduct if any members block him or her more than three times. If we find that they have been sending unacceptable content, we will terminate that person's agreement, and the ex-member will get no money back for unused time.

By registering with Flirtomatic, you agree that neither Handmade Mobile Entertainment Ltd nor its associates is liable for any damages, direct or indirect, that may arise from your participation in the Flirtomatic service. This includes any damages, without limitation, arising out of communicating or meeting with other participants registered with Flirtomatic. Such damages include, without limitation, financial loss, physical damages, bodily injury and or emotional distress and discomfort. This doesn't affect our liability for death or personal injury caused by our negligence.

Any use or misuse of this service by you is completely outside Flirtomatic's control and we are not liable for any loss, damage, expense or breach of Intellectual Property Rights which may arise.

Despite all our efforts to make sure you have fun, you indemnify and hold Flirtomatic harmless from and against all loss, damages, costs, expenses, claims and proceedings arising out of the supply of this service and any allegation and/or claim against Flirtomatic in respect of your use of this service, or anyone else who has access to, possession of, use or misuse, exploitation or enjoyment of your user details.

We know your personal information is yours, not ours.

When you create an account we will ask you for information such as your name, sex, email address or mobile number, date of birth and whether you'd like to flirt with men, women or both. The only details which automatically appear on your profile are your flirtname, your sex, your age and who you'd like to flirt with.

You may also add info, pictures and videos to your profile, which can be viewed by anyone and may be forwarded by these people to their firends. Pictures that you mark as private will only be available to your VIP friends with a backstage pass.

We use small text files called 'cookies' to allow you to sign back in to our site quickly and easily and to help personalise your experience. Cookies contain information that we can read when you revisit us. Most web browsers automatically accept cookies, but you can usually change your settings to reject them. If you do that, you may not be able to use some of our cool features which depend on cookies.

We may keep a copy of letters, emails and texts that you send to us (and flirtograms that you send to other users) to help us deal with your questions and improve the way we do things.

Our site allows you to send other users' profiles to your friends, in which case we will ask you for your friend's name and mobile number /email address. You must make sure that your friend is happy for us to get in touch with them before you give us their details. We will send your friend a one-time email or SMS explaining that you suggested we contact them with the chosen profile and inviting them to join our site. If your friend joins the site - fantastic! If not we will not use their information for any other purpose. We will be sure to provide your friend with details of how to request removal of their details from our database.

Our site includes links to other sites. Those sites are not our responsibility and should have their own terms and conditions and data protection policies. You should read those terms and policies to find out how your information is used and protected over there.

No-one else will see your personal information unless we ask you first and we promise not to use any of your personal stuff for any service or purpose other than what you want us to provide. The only exception to this rule is where we believe that the use or disclosure is necessary to comply with a law or regulation, to enforce these terms and conditions, or to enable us to provide our services.

Sometimes something may go wrong and we might lose data. Given the nature of technology, we are not held accountable for this. You can bet we'll be doing our best to ensure that nothing like this happens. Flirtomatic reserves the right to delete old stuff. At the moment we delete flirtograms that are more than 2 months old. If you want to keep hold of names or information, we recommend you write it down and store it somewhere safe.

To keep up to speed we may need to make changes to what we do which means we can change our service, website, policies and terms and conditions at any time. You can be sure we will try not to, but if it's necessary, these changes will apply to you once they go live.

We may, but aren't obliged, to monitor the materials posted in the public areas of this service. If we want to, we can remove anything that we think is bad stuff.

Remember - it's your content, you are responsible for it.

We hope it never comes to this BUT you may terminate your membership at any time, for any reason, effective upon receipt by us of your written or email notice of termination. You may contact us at our address listed below or you may email here.

If you've been very bad, we may immediately terminate your membership and your access to the Service because you have breached this Agreement and will send you notice of termination at the email address, if you provide this in your application for membership. If we terminate your membership in the Service because you have breached the Agreement, we will not refund any pre-payments made by you. We can terminate this contract at any time by giving you reasonable advance written notice.
